Neither myRateTrack nor any other party involved in your use of the services provided by this Web site shall have any responsibility for or be liable for any damages to you, your computer equipment, or any other property on account of your access to, use of, browsing in or downloading from this Web site.

  4. myRateTrack is not an agent of either you or any participating lender, mortgage broker or mortgage professional. You should rely on your own judgment in deciding which available loan product, if any, best suits your needs and financial means.
  5. myRateTrack is not a lender, mortgage broker or mortgage lending company. myRateTrack does not make loans or credit decisions in connection with loans, nor does it broker loans. myRateTrack does not endorse or recommend the products of any particular lender, mortgage broker or mortgage professional on this Web site. Brokers, lenders and mortgage professionals in the myRateTrack network are solely responsible for their services to you, and you agree that myRateTrack shall not be liable for any damages or costs of any type arising out of or in any way connected with your use of such services.
  6. Loans may only be made to residents of, or secured by real property located in, states where participating lenders and mortgage brokers are licensed or authorized to make such loans. Lenders and mortgage brokers are not attempting to make loans outside of their authorized states or country by participating in and offering their products on this Web site. myRateTrack and/or the participating lenders, mortgage brokers and mortgage professionals expressly reserve the right to discontinue, suspend or terminate any loan product in any specific state through this Web site.
  7. myRateTrack does not guarantee acceptance into any particular loan program or specific loan terms or conditions with any participating lender, mortgage broker or mortgage professional; loan approval standards are established and maintained solely by individual lenders. Likewise, myRateTrack does not guarantee that the loan terms or rates offered and made available by participating lenders, mortgage brokers and mortgage professionals through this Web site are the best terms or lowest rates available in the market. Unless expressly stated in writing, nothing contained herein shall constitute an offer or promise for a loan commitment or interest rate lock-in agreement.
  8. myRateTrack is not responsible for the accuracy of rates and loan information. Due to loan qualifying guidelines, credit score requirements, loan to value ratios, private mortgage insurance and other variables, mortgage rates may not be available and may change without notice. The participating lenders, mortgage brokers and mortgage professionals are responsible for the accuracy of rates and loan information.
  9. myRateTrack is committed to protecting your privacy. You have chosen to do business with us and we recognize our responsibility and obligation to keep the information you provide us secure and confidential. We do not provide any information about you to any third party unless you have authorized that third party to receive such information or such disclosure is required by applicable law. We do not sell names or e-mail lists to third parties.   Please note that by using a PROMO code provided to you by a lender, mortgage broker or mortgage professional to access this Web site, you have authorized such lender, mortgage broker or mortgage professional to have access to the information you provide to us and we have no liability to you for the receipt of such information by that party.  Any use by you of a PROMO code will be deemed to be consent by you to myRateTrack to disseminate information you provide to us to the lender, mortgage broker or mortgage professional that owns the PROMO code.
  10. myRateTrack intends that the information contained in this Web site be accurate and reliable. However, errors do occur on occasion. Additionally, myRateTrack may make changes to the information provided herein. This Web site and the information provided herein is provided to you “as is”, with no warranty of any kind, either express or implied. Your use of this Web site and the services provided herein is at your own risk. Neither myRateTrack nor any participating lenders, mortgage brokers or mortgage professionals are liable for any damages arising out of or in any way connected with the use or inability to use this Web site, whether such damages are direct, indirect, punitive, incidental, special or consequential.
  11. The initial term of this Agreement shall be one (1) year (the “Initial Term”). The Initial Term shall commence upon payment of the fee to myRateTrack. After the Initial Term, this Agreement shall automatically renew for successive terms of equal length, unless terminated or cancelled by either party as set forth in Section 12 of this Agreement. After the Initial Term, you acknowledge, agree and authorize myRateTrack to automatically bill and/or charge on your credit card for successive terms of equal length as the Initial Term, unless terminated or cancelled by either party as provided in this Agreement.
  12. This Agreement may be terminated: (i) by either party by giving the other party thirty (30) days prior written notice; (ii) by myRateTrack in the event of nonpayment by you; (iii) by myRateTrack, at any time, without notice if, in myRateTrack’s sole and absolute discretion, you are determined to be in violation of any term or condition of this Agreement.
  13. If you cancel this Agreement prior to the end of the Initial Term or any successive term thereafter, you shall not be entitled to any refund for the fees paid at the beginning of the term for services during such term.
  14. Upon termination of this Agreement for any cause or reason whatsoever, neither party shall have any further rights or obligations under this Agreement, except as expressly set forth herein. Termination of this Agreement and retention of pre-paid fees and charges shall be in addition to, and not be in lieu of, any other legal or equitable rights or remedies to which myRateTrack may be entitled.
  15. This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia without giving effect to any principles or conflicts of law. If any provision of this Agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.
